Starting January 21, 2025, at 5:00 UTC, the rules for open work permits for family members of foreign workers has been change. Here’s a simple breakdown of what’s happening:

If You Apply Before January 21, 2025:

• Applications sent in before this date will be processed under the previous eligibility criteria.
• If your open work permit is already approved and hasn’t expired, it will stay valid.

New Rules Starting January 21, 2025:

From this date, whether your family members can get an open work permit will depend on:

1. What type of worker you are in Canada
2. If you are on a pathway to permanent residence or have already applied for it

Who Is Eligible?

• Not Eligible: Family members of workers in low-skilled jobs (TEER 4 or 5 jobs) cannot apply.
• Eligible: Family members can apply if the worker is:
  • working in any TEER 0 or 1 occupation or,
  • working In select TEER 2 or 3 occupations, especially in industries with labour shortages or aligned with government priorities.

Extending Work Permits for Your Family Members in Canada

Your family members in Canada can apply to extend their open work permit even after January 21, 2025, if all the following conditions are met:

1. They are physically in Canada.
2. Their current work permit is valid for a shorter period than yours (the principal applicant).
3. They apply to extend their work permit before their current permit expires.

Important Notes:

• A work permit cannot be issued beyond the expiry date of:
  • Your work permit (the principal applicant).
  • Your family member’s passport or biometric validity.

Example:

If your work permit is valid until March 2027, but your family member’s work permit expires earlier (e.g., March 2026) due to their passport validity, they must:

1. Apply for a new passport.
2. Apply to extend their work permit.

Make sure your family members act promptly to maintain their work authorization in Canada.
